FAQ developed by Richard Weishaupt, CLS, Phila., in concert with a national group of advocates that has been negotiating with SSA on implementation of the recently passed SSI extension bill. SSA implementation instructions on which Q & A is based have not been finalized or published, and SSA is still in the process of training its staff.

PDF Document NPRM: Setting the Time and Place for a Hearing before an Administrative Law Judge

SSA proposes to clarify that the Agency is responsible for scheduling ALJ hearings. The rule will take most of the ALJ discretion of when/how to conduct hearings. Claimants retain the right to object to time/place/manner of ALJ hearings, including the right to appear in person and not by VTC. Comment period closes on January 9, 2008

The Urban Justice Center and the National Senior Citizens Law Center are in the process of identifying individuals who have had their SSI, SSDI, or RSDI suspended because SSA determined that there is an outstanding warrant for the person's arrest. Another Website NOSSCR Payee Discussion Board (EAJA fees)

The NOSSCR EAJA-Payee Board provides resources for plaintiffs' attorneys litigating issues pertaining to the proper payee of an award of attorney fees and expenses under 28 U.S.C. § 2412(d). The Board is a free public forum to discuss EAJA issues. Advocates can upload/download federal court decisions and any documents pertaining to individual cases that raise EAJA claims.
